1. Who you are contracting with
These Terms govern your use of PainMap (the "Service"), provided by PainMap ("we", "us", "our"). By creating an account, accessing, or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation. If you are using it as an individual, you confirm that you are of legal age to enter into a contract in your jurisdiction.
2. The Service
PainMap is a crowdsourced platform for surfacing real human frustrations ("pains"), scoring them by urgency and willingness to pay, and surfacing validated demand signals to founders. Some features (including premium feeds and demand-signal data) are available only on a paid subscription.
3. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- send spam, deceptive content, or impersonate any person or organisation;
- infringe intellectual property rights or post content you do not have rights to;
- upload malware, probe, scan, or otherwise interfere with the security or integrity of the Service;
- scrape, mass-download, or attempt to circumvent technical limits or rate limits;
- reverse engineer the Service, except where law expressly permits it;
- resell, redistribute, or sublicense the Service or any data obtained from it.
4. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date. Notify us promptly of any unauthorised use.
5. Your content
You retain ownership of the pains, comments, and other content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process that content solely as needed to operate, improve, and promote the Service.
6. Our intellectual property
We and our licensors retain all rights, title, and interest in the Service, including its software, designs, trademarks, and aggregated data. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with these Terms and your selected plan.
7. Payments, subscriptions, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, renewals, cancellations, and refunds are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled. 8. Service availability and warranties
We work hard to keep the Service available, but we do not guarantee uninterrupted, error-free, or perfectly secure operation. To the fullest extent permitted by law, the Service is provided "as is", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or exemplary damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as fraud, death, or personal injury caused by negligence).
10. Indemnity
You will indemnify and hold us harmless from any third-party claim arising out of your content, your use of the Service in breach of these Terms, or your violation of law.
11. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay fees when due, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends; you may request export or deletion of your data within a reasonable window before we delete it.
12. Changes to the Service or these Terms
We may modify the Service or update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the jurisdiction where PainMap is established. Any dispute will be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, except where applicable consumer law grants you the right to bring a claim in your country of residence.
14. Assignment, force majeure, severability
You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond reasonable control. If any provision is held unenforceable, the remaining provisions remain in full force.
